⚖️ Preamble & Statutory Notice

This master document constitutes a legally binding agreement between SSTS (SUDEEKSHASHIV TRUST SIWANI) (“Sudeeksha Shiv Trust”, “Trust”, “We”, “Us”, or “Our”) and any individual, corporate entity, or organization (“User”, “Donor”, “Volunteer”, or “Visitor”) accessing our digital ecosystem at www.sudeekshashivtrust.com or contributing to our charitable operations. This document incorporates international standards (including EU GDPR principles) and Indian statutory enactments including the Indian Trusts Act 1882, Income Tax Act 1961 (Sections 12A & 80G), Information Technology Act 2000, and the Digital Personal Data Protection (DPDP) Act 2023.

1. Legal Identity, Incorporation & Governance

1.1 Statutory Registration: SSTS (SUDEEKSHASHIV TRUST SIWANI) is a duly constituted, legally registered public charitable trust established under the provisions of the Indian Trusts Act, headquartered at Siwani, District Bhiwani, Pincode 127046, Haryana, India. The Trust holds valid 12A registration and 80G tax-exemption certification issued by the Income Tax Department, Government of India.

1.2 Governing Fiduciary Board: The Trust operates under the strict fiduciary and administrative oversight of an independent Board of Trustees led by Founder Dr. Rubby Beniwal and Governing Committee Members Madam Krishana, Madam Santosh, and Madam Suman. All fiscal assets, capital reserves, and philanthropic grants are managed in alignment with statutory non-profit governance standards.

1.3 Core Motto & Institutional Objective: The Trust was established with the specific aim to educate, create social awareness, and foster human self-realization under the core motto: “Be A Light Unto Yourself” and the operational directive: “If you can then you should. If you should then you must.”

2. Global Donor Terms, AML/KYC & Section 80G Tax Deductibility

2.1 Voluntary Nature of Contributions: All monetary gifts, contributions, and grants remitted to the Trust via direct UPI (QR917404248017-0540@unionbankofindia), direct bank transfer (Union Bank of India Current A/C 524201010030540, IFSC UBIN0552429), payment portals, or cheques are irrevocable, voluntary charitable gifts dedicated to non-profit social welfare causes.

2.2 Anti-Money Laundering (AML) & KYC Verification: In compliance with the Reserve Bank of India (RBI) guidelines and Prevention of Money Laundering Act (PMLA) regulations, the Trust enforces strict Know Your Customer (KYC) standards. The Trust reserves the right to reject contributions originating from anonymous, untraceable, or suspicious sources.

2.3 Section 80G Tax Exemption (Form 10BE): Donors seeking tax deduction under Section 80G of the Income Tax Act, 1961 must provide their valid Permanent Account Number (PAN), full statutory name, and address. Upon verification and filing with the Central Board of Direct Taxes (CBDT), official Form 10BE receipts will be dispatched to the donor.

2.4 Foreign Contribution Regulation Notice (FCRA): Unless explicitly authorized under an active Foreign Contribution Regulation Act (FCRA) registration, the Trust accepts donations strictly in Indian Rupees (INR) from Indian bank accounts or authorized non-resident Indian (NRI) sources compliant with Ministry of Home Affairs (MHA) guidelines.

3. Refund, Cancellation & Duplicate Transaction Policy

3.1 Non-Refundable Mandate: Because charitable funds are immediately allocated toward operational field projects (such as purchasing medical kits, tree saplings, food supplies for Annadanam, or educational materials), donations are generally non-refundable once processed.

3.2 Erroneous / Duplicate Transfer Resolution: In the case of a proven technical error resulting in an accidental duplicate transaction or incorrect amount transfer, the donor must submit a formal refund application within seven (7) calendar days of the transaction date to sudeekshashiv@gmail.com containing bank debit proof and transaction reference details. Approved refunds will be remitted to the original payment source within 7 to 10 working days after statutory verification.

By interacting with our platform, users acknowledge that Sudeeksha Shiv Trust conducts humanitarian initiatives across 26 recognized public interest domains:

5. Intellectual Property, Trademarks & Brand Protection

5.1 Proprietary Ownership: All digital assets on www.sudeekshashivtrust.com—including the official golden emblem logo (Trishul, Lotus, and Caring Hands mark), website design architecture, graphics, copyrighted texts, project documentation, and photography—are the exclusive intellectual property of SSTS (SUDEEKSHASHIV TRUST SIWANI).

5.2 Restrictions on Use: No individual or organization may copy, retransmit, scrape, frame, mirror, or commercially exploit any trust logo, trademarked tagline, or media without prior explicit written authorization executed by the Board of Trustees.

6. Volunteer Code of Conduct & Field Activity Disclaimer

6.1 Non-Employee Status: Volunteers, field workers, and community coordinators participating in tree plantation drives, medical checkups, or workshops act as voluntary contributors and do not hold an employer-employee relationship with the Trust.

6.2 Prohibition of Unauthorized Solicitation: Volunteers and third parties are strictly prohibited from soliciting cash donations or executing legal agreements in the name of Sudeeksha Shiv Trust without official credentials signed by Founder Dr. Rubby Beniwal.

7. Data Privacy, DPDP Act 2023 & GDPR Compliance

7.1 Privacy Commitment: We process personal data in strict alignment with India’s Digital Personal Data Protection (DPDP) Act 2023 and international privacy frameworks (EU GDPR Article 6/13). Personal data (Name, Contact Details, Email, PAN Card, Transaction Records) is collected solely for donor record-keeping, statutory reporting, and issuing 80G certificates.

7.2 Confidentiality Guarantee: Sudeeksha Shiv Trust maintains a strict zero-third-party-data-monetization policy. We never sell, rent, trade, or disclose donor data to commercial telemarketers or external entities.

8. Limitation of Liability & Indemnification Covenant

8.1 Cap on Liability: To the maximum extent permitted under applicable law, Sudeeksha Shiv Trust, its Founder Dr. Rubby Beniwal, Trustees, Officers, and Employees shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from platform downtime, network latency, or payment gateway failures.

8.2 Hold Harmless Agreement: The User agrees to defend, indemnify, and hold harmless Sudeeksha Shiv Trust from and against any third-party claims, liabilities, losses, or legal expenses resulting from the User’s breach of these Terms or unauthorized website activities.

9. Binding Dispute Resolution & Sole Legal Jurisdiction

9.1 Informal Resolution Period: In the event of any dispute or claim, the parties agree to first attempt resolution through good-faith informal negotiations for a minimum period of thirty (30) days.

9.2 Statutory Arbitration & Jurisdiction: Unresolved disputes shall be referred to binding arbitration under the Indian Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Bhiwani, Haryana. All legal proceedings shall fall under the exclusive territorial jurisdiction of the competent courts in Bhiwani / Haryana, India.
